Workers’ compensation lien
Did you know it is still possible to pursue subrogation recovery on a workers’ compensation lien for a lien that accrued outside of Ohio? You may pursue reimbursement of the lien up to two years from the date the lien was paid.
Subrogation recovery
While the Bureau handles workers’ comp liens in Ohio, if an out of state worker is injured and files suit in Ohio, the workers comp law of the state where the workers’ comp policy originated will control the lien and determine whether subrogation can be pursued. If your state allows for subrogation on workers comp liens, and your insured is injured and files suit in Ohio, you are still able to pursue that lien here in Ohio.
