Statute of limitation for breaches of written contracts

In 2021, Ohio Revised Code 2305.06 was changed and reduces the statute of limitation for breaches of written contracts from eight years to six years after the cause of action accrues.  Breach of contract claims that accrued before June 14, 2021 must be filed by June 14, 2027 or the remaining period under the prior eight-year statute of limitations. 

Ohio Revised Code 2305.06 states an action upon a specialty or an agreement, contract, or promise in writing shall be brought within six years after the cause of action accrued.

Ohio Revised Code 2305.07 states an action upon a contract not in writing, express or implied, shall be brought within four years after the cause of action accrued.

Further, Ohio Revised Code 2305.07 reduces the statute of limitation for breaches of oral contracts from six years to four years.  Therefore, breach of oral contract Complaints must be filed before June 14, 2025 or the remaining period under the prior six-year statute of limitations.
